Citizen Groups unhappy with High Court Order.

The Ministry of Communications & Information Technology of UPA II had informed the Citizen Groups that only the fixing of the  EMF Radiation Norms was the jurisdiction of the Central Government and all locational and installation regulations were the jurisdiction of the State Governments and Local Bodies. So the argument made by the COAI and TAIPA is false.

The DoT guidelines are only Advisory Guidelines to States and NOT MANDATORY on States was informed to Citizen Groups by the UPA II government Ministry of C & IT which is the reason why the Title of the intimation to States reads

ISSUE OF CLEARANCE FOR INSTALLATION OF MOBILE TOWERS

(Effective from 01.08.2013)

It is not possible for State Government to prescribe the upper limit of radiation as this is the jurisdiction of the Central Government. Citizen Groups will assist the State Government to file affidavits to lift this Stay Order which will affect the health of millions in the State of Maharashtra. The Citizen Groups are bringing to India two International globally reputed Radiation experts – one of them being a part of the expert Committee of World Health Organisation / International Agency of Research on Cancer which classified in May 2011 EMF Radiation as “ Possibly Carcinogenic to Humans.”

The Division Bench of Hon’ble Justices V M Kanade and P D Kode should give Citizen Groups a chance to be heard .

The State Government and BMC must not succumb to Legal pressures by TAIPA and COAI who have always taken advantage of the Indian Legal System. Although regulations are in place ( industry friendly ) the BMC despite various requests have not taken any steps to approach the High Court to vacate the 2011 Stay Order. 70% of the Towers are illegal in Mumbai.

How can we have legal protection for illegal actions ?

Have our Children and Patients in Hospitals be treated like Lab Rats ?

Is there no justice for Residents near Hospitals or for Children playing in Open Grounds ?

Will the State Government in Maharashtra and the BMC join hands to fight this Stay Order which is ultravires the Constitution of India which give the Citizens a Fundamental Right to Health and all concerned who are elected have taken a vow to protect the Rights given by the Constitution of India.

The Hon’ble Judges should be made aware of the May 31, 2011 WHO Press Note which has classified the EMF Radiation as possibly carcinogenic to Humans.
